US: OPA 90 INCREASES TO THE LIABILITY AMOUNTS

The US Coast Guard has given advance notice that it will be issuing a final rule to adjust the limits of liability for vessels, deep water ports, and onshore facilities under the Oil Pollution Act of 1990 (OPA 90), as amended, to take into account inflation since 2015. The Coast Guard confirms that these regulatory inflationary increases to the limits of liability are required by OPA 90 and are necessary to preserve the deterrent effect and “polluter pays” principle embodied in the Act. This final rule will come into effect on 12 November 2019.
