TURKEY: NEW REGULATION ON ENVIRONMENTAL INSPECTION

On 12 June 2021 Turkey implemented The Regulation on Environmental Inspection (The “Regulation”) with a view to strengthening its regulatory measures in relation to environmental pollution with the assistance of, inter alia, expert inspection teams. The Regulation imposes stricter monitoring of marine pollution arising from ships and allows for fines to be imposed on visual evidence alone without the requirement of sample analysis in all cases. A Club LOU will continue to be a valid form of security although the Regulation stresses that if vessel interests fail to either make a payment or provide security the vessel will be at risk of being detained indefinitely and even sold at a public auction.
